Welcome to NotaryPing, an on-demand notary service application. By using our app and services, you agree to these Terms and Conditions (“Terms”). Please read them carefully, as they govern your access to and use of the NotaryPing app, website, and related services (collectively, the “Service”). 

If you do not agree to these Terms, please do not use NotaryPing.

1. Acceptance of Terms

By registering for, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions referenced in these Terms. NotaryPing reserves the right to modify these Terms at any time, and any changes will be effective upon posting the updated Terms on the app. Continued use of the Service indicates your acceptance of any modifications.

2. Eligibility

To use NotaryPing, you must be at least 18 years of age and legally capable of entering into binding contracts. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to suspend or terminate your account if we believe you do not meet these requirements.

3. Registration and Account Security

You must create an account to use the Service. You agree to:

– Provide accurate, current, and complete information during registration.

– Maintain the security of your account by keeping your password confidential.

– Notify NotaryPing immediately of any unauthorized use of your account.

You are responsible for all activities conducted under your account.

4. User Responsibilities and Conduct

When using NotaryPing, you agree to:

– Use the Service in compliance with all applicable laws and regulations.

– Only use the Service for lawful, personal, and non-commercial purposes.

– Refrain from impersonating others or providing inaccurate information.

– Not engage in any activity that may disrupt or interfere with the Service.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful behavior toward other users or NotaryPing.

5. Service and Fees

NotaryPing offers an on-demand notary service. The fees for each notary session are displayed within the app and may vary based on location, time, and other factors. By booking a notary service, you agree to pay all applicable fees. NotaryPing reserves the right to modify fees at any time, and changes will be effective when posted in the app.

– Payment Processing: Payments are processed securely through third-party providers. By submitting your payment information, you authorize us to charge the applicable fees to your chosen payment method.

6. Cancellations and Refunds

You may cancel a scheduled notary session, subject to certain limitations as described in the app. NotaryPing reserves the right to determine the cancellation policy and any associated fees. Refunds are processed at our discretion based on the specific circumstances of each case. 

7. License and Intellectual Property

NotaryPing grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal use only. You agree not to:

– Reproduce, modify, distribute, or otherwise exploit any part of the Service.

– Reverse-engineer or attempt to extract source code from any part of the Service.

All content, trademarks, and intellectual property within NotaryPing are owned by NotaryPing and are protected by applicable copyright, trademark, and other intellectual property laws.

8. Privacy and Data Security

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your data as outlined in the Privacy Policy. You are responsible for ensuring that any information you provide is accurate and up-to-date.

9. Limitation of Liability

To the fullest extent permitted by law, NotaryPing and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or goodwill, arising from or related to your use of the Service.

NotaryPing’s total liability for any claim arising from or related to the Service is limited to the amount you paid for the Service in the three (3) months preceding the claim.

10. Dispute Resolution and Arbitration

By using NotaryPing, you agree that any disputes arising out of or related to these Terms or the Service will be resolved through binding arbitration on an individual basis, rather than in court. This means that you waive your right to a jury trial and your ability to participate in class actions.

The arbitration will be conducted by a reputable arbitration provider under its applicable rules. Any award in arbitration is binding and may be enforced in any court with jurisdiction. 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which NotaryPing is headquartered, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that state.

12. Third-Party Links and Services

Our Service may include links to third-party websites or services. NotaryPing is not responsible for the content, privacy policies, or practices of third parties. By using the Service, you acknowledge and agree that NotaryPing shall not be liable for any loss or damage related to your use of third-party content, goods, or services.

13. Termination

NotaryPing reserves the right to terminate or suspend your access to the Service at our discretion, without notice, for conduct that violates these Terms or is harmful to other users or the Service. You may also terminate your account by contacting us. Termination of your account does not relieve you of any payment obligations or restrict our right to pursue other available remedies.

14. Modifications to the Service

NotaryPing reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. NotaryPing disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be error-free, secure, or uninterrupted.

16. Entire Agreement

These Terms, along with the Privacy Policy and any additional terms to which you agree when using specific features of the Service, constitute the entire agreement between you and NotaryPing regarding your use of the Service.
